Working under the guidance of the Head of Commercial Operations and alongside the Project Managers to deliver the commercial operational commitments of the business and / or project(s) in accordance with the Company’s policies. The Commercial Manager is responsible for managing all commercial and contractual aspects of the projects ensuring compliance with and obligations and objectives are met at a project and company level. Advising Project Managers on appropriate course of action and ensure the project team effectively minimises risks.

As part of the Commercial team, you will be responsible to turn a construction concept into a contract with suppliers and subcontractors and help them fulfil the design and construction of new solar projects.

Key responsibilities and accountabilities

  • Negotiate, Manage & Maintain Insurances for SEA Business and Projects
  • Maintain a suite of Contracts, including
  1. Purchase Order
  2. Supply Agreement
  3. Professional Services Agreement
  4. Minor Works Subcontract
  5. Major Works Subcontract
  • In conjunction with the Project Manager and Commercial team
  1. Ensure tenders, quotations and contracts appropriately evaluate commercial risks, include contract terms and conditions which suitably protect SEA interests
  2. Conduct commercial evaluation of tenders from subcontractors and suppliers. Advise unsuccessful bidders of result.
  3. Issue and execute contracts
  • Negotiate contracts and conditions, upstream and downstream
  • Use of dispute avoidance techniques
  • Lead dispute resolution and litigations, as necessary
  • Prepare and issue contractual notifications, including EOTs, variations, LDs etc. as necessary
  • Liaise with external Legal Advisers, as required
  • Accountable for Business Contract Registers and associated processes
  • Accountable for Business Variation Registers and associated processes
  • In consultation with the Project Manager identify contractual risks and opportunities and implement appropriate solutions
  • Provide assistance and guidance to staff, including project managers, project engineers and contracts administrators on commercial and contract administration matters.
  • Establish and maintain clear communications with vendors on a regular basis to ensure supply of goods or services and develop strong relationships
  • Establish and monitor the Procurement Plan and Schedule of Trade Packages.
  • Manage project purchasing and procurement to ensure value, quality maximization.
  • Work in conjunction with Planning and Construction team to ensure on time delivery of all goods and services.
  • Complete close out of supply of goods and services; ensure documentation as required is completed.
  • Put in place plans at a project level that address commercial issues and ensure contract compliance with time bars, submissions, notices and the like
  • Ensure the project team provides / maintains records in commercial matters to protect SEAs position
  • Assist in the resolution of disputes etc., in conjunction with the Project Manager, Head of Operations and where applicable, Legal personnel.
  • Undertake regular contract reviews including post-contract completion reviews, analyse results and recommend and/or undertake corrective action as necessary.
  • Ensure activities related to the function comply with relevant Acts, legal demands and ethical standards.
  • Ensure that project documentation and correspondence is in accordance with requirements and all legal risk areas are identified, reported and mitigated to allow adequate risk management strategies to be effected.
  • Ensure compliance with all record keeping requirements
  • Manage and monitor contract securities, insurances, accounts and billings to clients
  • Participate in the completion of monthly internal and external reporting as required;
  • Elevate any project issues as necessary

Qualifications and Education Requirements

  • Degree or Diploma in Business, Quantity Surveying, Construction Management or equivalent
  • Minimum 8 years’ experience in Contract Administration with Tier 1 or 2 company experience
  • Understanding of construction principals and legal arguments
  • Team player that can work across a number of projects simultaneously
  • Demonstrated experience in the negotiation and management of commercial contracts
  • Strong communication skills (oral & written) including strong negotiation and influencing skills and the ability to establish effective working relationships with a variety of people at different levels both internally and externally.
  • Demonstrated ability to work independently to organise and prioritise demands
  • Sound knowledge and practical experience in the application of commercial and contract law
  • Experience in consultation and stakeholder management
